My brother and I have new laptops, he has windows vista Home Premium and I have Ultimate, he was asked to activate the product but I have not, is there an explanation for this?

There are 3 basic types of activation for Vista:
Retail - usually when you buy Vista and install it yourself
OEM - usually installed by the computer manufacturer
Volume - mainly applies to businesses, not home users.
OEM and volume licences are normally pre-activated so you only need to manually activate retail copies of Vista. It appears that your product was pre-activated but your brothers was not. Another possibility is a known bug with activation, see http://support.microsoft.com/kb/931573
