    UK Online Banking requirement for AV & firewall

    A recent newsletter tells UK online banking users:
    <hr>WARNING! You may be liable for bank fraud without updated anti-virus, anti-spyware, and a personal firewall.

    The {British} Banking Code* stated long ago that those using any bank facilities online should “use up-to-date anti-virus and spyware software and a personal firewall.” Yet the Guardian {UK daily newspaper} has just spotted that a sentence was added in March: “If you act without reasonable care, and this causes losses, you may be responsible for them”, which then uses the anti-virus bit as an example. The British Bankers' Association says this was a clarification, yet it’s a salutary warning.<hr>
    Might be worth checking in your country/with your own online bank whether there is any similar requirement?

    Yes, saw the article. I wonder whether banks might, at some point, try to differentiate between commercial, paid for, firewall/anti virus programs and free ones? It's been a worry of mine for a number of years and one of the reasons I stick with NIS, despite its heavy drain on resources (software and financial!!!).

    I would think not - the criterion appears to be that you need to take all reasonable steps to protect your PC, and whether the programs you use are <img src=/S/free.gif border=0 alt=free width=30 height=15> or paid-for should not be relevant.

    but if you are using a freebie and suffer a loss could you not then reach for your lawyer and try and pass the problem down the line to the AV provider? If such an action ever suceeded can you imagine how quickly free products would disappear?

    I don't think any free or paid-for program will guarantee that it will always operate correctly under all circumstances. Even less so could an AV manufacturer foresee (and code for) a previously unknown virus threat mechanism, for example.

    Any time the word "reasonable" appears, there are going to be arguments. <img src=/S/smile.gif border=0 alt=smile width=15 height=15> But the alternatives (no duty of care at all or strict liability regardless of fault) can be quite unfair.
